Recently, the business ombudsman’s office discussed with its participants at a round table on “Monitoring of control and supervisory activities. Interim results and current tasks” the idea of ​​replacing traditional inspections with preventive visits.

This approach involves a transition from punitive measures to preventive ones, which will reduce administrative pressure on businesses and increase their motivation to voluntarily comply with the law.

Preventive visits will allow regulatory authorities to carry out supervisory actions and issue orders without applying administrative sanctions, which is especially important for small and medium-sized enterprises, which often face difficulties in adapting to new legal requirements.

The Deputy Expert and Legal Service of the Commissioner for the Protection of Entrepreneurs’ Rights emphasized that the risk indicators of violations, being only signs of violations, should not automatically lead to an unscheduled inspection, especially with respect to objects of control classified as low and medium risk.

In relation to such objects, the indicators should become the basis for carrying out preventive measures, including “compulsory” professional visits.

The introduction of professional visits as an alternative to both scheduled and unscheduled control and supervisory measures planned for all categories of business entities can become an important step in the development of the controlling system.

Preventive visits should become a tool not only for preventing violations, but also for providing advisory assistance to businesses, which will improve their legal literacy and reduce the number of errors.
