Employment agreement in e-form

The draft law has been submitted to the State Duma providing possibility to conclude Employment agreement by means of document exchange using electronic and other technical devices.

According to the current version of the Labor code Employment agreement should be concluded in a written form in 2 original copies, and each of them should be signed by the parties.

This draft law also allows a legally relevant communication in the digital form in the field of labor law, for example sending vacation request or letter of resignation.

However, the possibility of documents exchange in e-form should be provided by labor agreement and employee must have a right to waive from this clause of the agreement.

The sender of such messages should be identified by any reliable means, for example by preliminary specifying e-mail addresses for communication in labor agreement or by using electronic signature.
